The Virginia Supreme Court has agreed to hear the appeal of the Bay Oaks Park Committee, according to attorney Andrew Sacks, who represents the group.
Bay Oaks is a 21-acre parcel of land in East Ocean View that the group wants to have as a park. They gathered 5,376 signatures on a petition in an attempt to force the issue onto the ballot in the form of a referendum. Norfolk’s charter has the strictest rules on the granting of citizen-initiated referendum, so strict, in fact, that none has made it to the ballot since the charter was changed back in the 1950s.
No word on when the appeal will be heard. No action has been taken on the development of the property, pending the outcome of the hearing.
