On selecting Virginia’s judges

My latest op-ed appeared in The Virginian-Pilot Wednesday. Like so many things in our commonwealth, the selection of judges is in the hands of the legislature. LG Bill Bolling, who has been running for governor as long as I’ve known him 😉 , may be on to something.

There are so many issues with having judges chosen by the legislature, some of which I mention in this article. I have to admit, though, that having lawyers pick the judges they practice in front of is at the top of my list.

  1. Our way of choosing judges isn’t perfect. But it’s certainly better than electing them, in that system lawyers buy the judges they’ll practice before. If we have to change, how about stealing the federal system..the governor would nominate and the General Assembly confirm?
